Some states use the terms driving under the influence (DUI) and driving while impaired (DWI) interchangeably. The state of Maryland has two different charges.

A DUI In Maryland

Facing a DUI charge in Maryland means that your blood alcohol content registered at .08% or higher at the time of the stop. You are considered legally drunk under the law and your test results alone could be sufficient proof to convict you.

A DWI In Maryland

A DWI charge is typically reserved for drivers who have a blood alcohol content below .08% but show evidence of alcohol or drug impairment. Examples include erratic driving, slurred speech, difficulty following directions, among others.

What Consequences Could You Face If Convicted?

DWI convictions tend to carry lower sentences than DUI convictions, but the consequences are still serious. A first conviction for DWI could result in fines of up to $500, a jail term of up to two months and license suspension for up to six months. Penalties increase for repeat offenses.

A DUI conviction is more consequential. A first offense can result in fines as high as $1,000, up to a year in jail and a license suspension of up to six months. Penalties increase significantly for subsequent convictions.

The specific penalties you face will depend on factors such as:

  • Your blood alcohol content
  • Previous convictions on your record
  • Your fault if your vehicle was involved in a car accident
  • Whether anyone else was injured or killed in the accident
  • If a minor was in your vehicle at the time of your stop and arrest
